Procurement Guidance

SDB, VBE & DBE Participation Participation that counts, documented correctly.

Commonwealth solicitations can carry contract-specific SDB and VBE goals, and transportation work brings DBE and PennDOT Diverse Business requirements. PA NextGen helps prime vendors understand which programs apply, plan participation tied to delivered scope and document it correctly. For PA NextGen’s own certifications, see Small Diverse Business.

What it covers

Scope of the service

  • Which program applies: DGS SDB verification through BDISBO, federal DBE/ACDBE certification through the PA UCP, or PennDOT’s Act 89 Diverse Business program
  • The Act 89 distinction: the PennDOT Diverse Business program covers 100% state-funded transportation construction and professional services contracts, is separate from the DGS SDB program, and is verified separately by PennDOT’s BWBO
  • Commercially useful function: only amounts actually paid to an SDB for a commercially useful function count toward the commitment, and an SDB subcontractor must perform at least 50% of its subcontract with its own employees
  • Eligibility to count: participation counts only while a firm’s status is current
  • VBE goals: access to a Pennsylvania service-disabled veteran-owned business partner for solicitations that carry VBE goals
  • Out-of-state transportation work: PA NextGen’s PA UCP DBE certification makes it eligible to apply for interstate certification in other states’ UCPs
  • Participation documentation and BDISBO reporting

PA UCP re-evaluation, recertification and the interstate process are covered in detail on the Small Diverse Business page.

How we work

Our approach

  1. Identify

Determine which programs and goals apply to the solicitation and its funding source.

  2. Scope

Tie participation to a commercially useful function within the scope actually delivered.

  3. Commit

Document the commitments, which become contractual obligations.

  4. Report

Support participation documentation and reporting through delivery.

Typical outcomes

What you can expect
